Biography: Construction

Elena Barinova has broad experience of the structuring of, and legal support for, general real estate and property finance transactions, both domestic and cross-border, including assistance for major investment projects covering acquisition and construction of real estate (including joint venture and shared construction transactions); financing for real estate and real estate-related businesses, including development of collateral structures; restructuring of distressed development projects; advising on enforcement of collateral; lease of commercial property and land; privatisation of state and municipally owned real estate, including brownfield and greenfield sites, redevelopment of industrial and other sites for construction of commercial facilities, and preparation of and participation in public tenders.

Elena is very experienced in representing clients in courts of different levels with regard to real estate disputes. Who's Who Legal: CIS 2010 lists Elena as a recommended lawyer in the real estate sector and makes a special mention of her vast experience in supporting greenfield and brownfield projects.

Elena's projects include supporting Sistema Hals in a number of development projects; advising Fleming Family & Partners in the sale of an industrial project; advising a prominent international investor on exiting from a distressed development project; Representing Linstow AS on financing and acquisition of a future hotel development in Moscow (due diligence, structuring, documenting and negotiating the deal); advising Immoeast AG in obtaining a loan facility from an international bank for a real estate project (including preparation and negotiation of a security package); advising Credit Suisse on acquiring a residential property developer in the Moscow area; advising a major multinational financial institution on providing real estate-related financings for Russian borrowers; representing Tomilino Logistics Park before Fleming Family &Partners, ImmoEast and Raven Russia in a series of deals involving forward financing and sale of warehouse facilities (finance, collateral, land, construction, lease, infrastructure, utilities, etc.); advising a major international food manufacturer on different aspects of pre-sale preparation and deal structuring for a development project in Moscow (including privatisation, change of permitted use, facility relocation and other matters); advising Danone on legal issues relating to extension of manufacturing facilities, land acquisition and liaising with the authorities; and participating in the 'Year 2006 deal' on the Moscow commercial real estate market, the lease of Hermitage Plaza (38800m2) by VimpelCom.
