Malcolm has exceptional industry knowledge and understanding of business models, regulatory developments and communications technologies. His recent experience includes advising on next generation broadband projects in Australia, New Zealand and Singapore; subsea cable arrangements throughout the Asia Pacific region; infrastructure sharing transactions and wholesale agreements in the Asia Pacific and Middle East; access to content and net neutrality issues; mobile termination rates; market liberalisation and complex procurement transactions.
Malcolm also advises clients on major corporate and commercial transactions in a number of other sectors, including energy, infrastructure, broadcasting and transport. He advises corporates and governments on complex technology deals. Some of Malcolm's recent experience includes: advising NBN Co on the development of its wholesale terms and conditions for access to its high speed broadband network and advising the major New Zealand ISPs on the equivalent terms in New Zealand; advising PCCW in Hong Kong on the restructuring of Reach, its international subsea fibre and satellite joint venture with Telstra International; and advising a New Zealand mobile operator on all regulatory matters relating to mobile termination, national roaming and infrastructure sharing and associated commercial transactions.
Malcolm is a past chair of the communications law committee of the IBA.
