Biography: Project Finance

Claire Barclay is a director in the firm's finance, projects and banking practice and specialises in public sector procurement, including public-private partnerships (most notably in the defence, transport - road, rail and pipelines - and accommodation sectors), public financial management, project and infrastructure finance, municipal service delivery law, and administrative and constitutional law.

Claire holds a BA LLB and obtained her LLM (cum laude) in comparative constitutional law from McGill University. She was admitted as an attorney in 2001 and spent a year clerking at the Constitutional Court of South Africa.

Claire advises governments, public bodies, including state-owned enterprises and municipalities as well as private sector clients such as bidding consortia and lenders on issues relating to all aspects of public sector procurement and has extensive transactional experience relating to PPPs. She has advised public sector clients in relation to the establishment of public entities, disestablishment of municipal entities and on the establishment of infrastructure development funds in the public sector.

Some of Claire's current projects include advising the government of Mauritius through its Road Development Agency in respect of four major tolled highways around Mauritius; advising a large chemicals company on all project and financing aspects relating to a uranium mine in southern Namibia; advising the South African Department of Defence in its new navy headquarters and marine sea safety training centre, as well as on the establishment of a new defence training institute and a new military health services building; advising the South African Department of Rural Development and Land Reform in its new head office accommodation PPP and the Department of Justice and Constitutional Development in its management of third party funds PPP; advising a lender to a consortium bidding on the Department of Correctional Services prisons PPP; and, being appointed by the South African National Treasury to develop a toolkit for accommodation PPPs and in respect of a review of the first hospitals co- location PPP in the Free State Province. Claire is also involved in various other public sector transactions, including advising on the establishment of the Gauteng Funding Agency, an agency tasked with investments in infrastructure projects in Gauteng; advising the Gauteng Provincial Treasury in respect of certain roads projects; and the establishment of a new municipal entity under a district municipality tasked with generating social and economic development.
