Biography: Insolvency & Restructuring

Timothy R Pohl represents a variety of clients in complex business reorganisations, debt restructurings and insolvency matters, including companies experiencing financial difficulties, purchasers of and investors in distressed companies, and lenders to and creditors of such companies.

Mr Pohl has led the restructuring of numerous large corporations in their Chapter 11 cases, including National Steel Corporation, McLeodUSA Incorporated, ICG Communications Inc, Orius Corp and Diamond Brands Inc. Mr Pohl has also led the successful out-of-court restructurings of many companies including: Reliant Resources Inc, ITC DeltaCom, Rural Cellular Communications, American National Power Inc, InterGen NV, and Krispy Kreme Corporation in the restructuring of its troubled franchisees.

Mr Pohl has frequently been lead counsel to investors in and acquirers of distressed assets, including America West Airlines in its merger with US Airways Inc; OAO Severstal in its acquisition of Rouge Industries Inc; Danielson Holding Company in its acquisition of Covanta Energy; Trans World Entertainment Inc in its acquisitions of Musicland and Wherehouse Entertainment Inc; Black Diamond Capital Management in its acquisitions of Smarte Carte Corporation, PTC Alliance Corp and Sun World International Inc; and Goldman Sachs in the Conseco Finance Co restructuring.

Mr Pohl often represents secured lenders and providers of debtor-in-possession financing, and has also had substantial involvement representing unsecured creditors' committees.
