Biography: Banking

Brigette Baillie is a partner and head of the project development and finance practice at Webber Wentzel. She is experienced in the areas of non-recourse and limited recourse financing, structuring of projects, as well as corporate and equity finance, PPAs, construction contracts from standard form FIDIC and NEC contracts to bespoke construction, EPC and EPCM contracts, as well as the operation and maintenance contracts across a wide spectrum of sectors. Her experience in financing ranges from general banking facilities to limited or non-recourse financing to preference share and other corporate financings and equity acquisition financings. She has expertise in ECA and DFI financing as well.

Brigette achieved her BA LLB from the University of Cape Town and her LLM (corporate and commercial law) from London University (King's College). She achieved a second LLM (tax) from the University of the Witwatersrand.

Brigette's most recent and major transactions include advising the lenders on the financing of the development of Kalagadi Manganese's mine and smelter; advising Absa Bank Limited in the provision of limited recourse financing to Continental Coal Limited and Penumbra Coal (Proprietary) Limited in respect of the expansion and development of their coal mining activities; advising the South African government in respect of standardised PPAs and regulations for the procurement of IPPs; and advising the South African government in respect of the procurement of the REFIT IPPs.

Brigette's most recent and major transactions include advising the South African government in respect of standardised PPAs and regulations for the procurement of IPP; a consortium comprised of Old Mutual, a consortium of Israeli entities, Sanlam and Nedbank in respect of the ECIC-backed financing of the BeitBridge Border Post Concession in Zimbabwe and on related matters; Group Five, Strabag and Intertoll in respect of the Road Decongestion Program PPP Project in Mauritius; Companhia Moçambicana de Hidrocarbonetos, SARL in respect of the raising of additional debt in respect of the financing of its share of the expansion of its gas joint venture with Sasol Petroleum Temane at the Pande and Temane gas fields in Mozambique; the lenders in respect of the debt facilities required to finance the development and exploitation of a limestone quarry located in the Limpopo Province; a mining company on the limited recourse financing of the expansion of its coal mine in Botswana; the borrower in respect of the Mostazal casino project financing in Chile; Pan-African Infrastructure Development Fund (PAIDF) in respect of their acquisition of equity in TAV Tunisie, the company granted two airport concessions in Tunisia; Bakwena Platinum Corridor Concessionaire in respect of its refinancing of its limited recourse financing; DEG and Standard Bank of South Africa in respect of the provision of medium-term financing to ROMPCO.
