Shawn Neylan is a partner in the Toronto office of Stikeman Elliott LLP. His practice is primarily focused on the review of transactions under the Competition Act and the Investment Canada Act. Recent notable mandates include having led the regulatory teams for Lakeport Brewing Income Fund in its acquisition by Labatt Brewing Limited (where the Commissioner of Competition failed to get an order delaying closing in a landmark Competition Tribunal ruling), CVRD (now Vale) in its groundbreaking acquisition of the Canadian icon Inco Limited, and PaperlinX Canada Limited in its acquisition of Cascades Resources Division (negotiation of a merger remedy).
Mr Neylan has advised on many public and private transactions. He has extensive experience with a wide variety of industries and in conducting merger litigation. Mr Neylan has written and spoken many times on competition and investment review issues including merger remedies, potential amendments to the conspiracy provisions of the Competition Act, the limits on dominant firms' ability to compete in the marketplace, the review of acquisitions by state-owned enterprises and the treatment of inbound capital under the Investment Canada Act. He has worked on many international competition teams, both as global competition filing leader and in providing Canadian regulatory representation. Mr Neylan was admitted to the bar in British Columbia in 1988 and in Ontario in 2000.
Mr Neylan focuses on negotiating effective regulatory provisions in agreements and then advancing through the regulatory process in a prompt and pragmatic manner by developing strategy, obtaining all necessary clearances, negotiating remedies or resisting government challenges, as may be appropriate.
