Biography: Employee Benefits

Felicia A Finston has a broad-based practice that involves the design, implementation, and administration of qualified retirement plans, nonqualified retirement plans, health and welfare plans, section 162(m) performance-based plans, equity compensation plans, and executive employment and change of control agreements.

Her clients include Fortune 500 companies and other large publicly traded corporations, private corporations, partnerships, and tax-exempt entities (including church-related organisations and government employers). A significant portion of Ms Finston's practice involves representing clients before the IRS, DOL and PBGC, both in connection with employee benefit plan audits and under voluntary submission programs, such as EPCRS and DFVC.

Ms Finston routinely represents clients with respect to fiduciary matters, including investments in employer stock, prohibited transaction issues, participant-directed investments and the arbitration of benefit disputes. Her practice also involves corporate transactions and governance matters, such as advising clients with respect to SEC disclosure and filing issues, shareholder approval issues, and proxy disclosure requirements involving compensatory arrangements. She also regularly advises clients on health plan regulatory matters, including HIPAA compliance issues and Medicare coordination of benefit matters.

Ms Finston's extensive experience has earned recognition by The Best Lawyers in America in employee benefits law for the past three years; she also was selected by Texas Monthly as a 'Texas Super Lawyer' in employee benefits law, 2004-2006. Additionally, she is a fellow in the American College of Employee Benefits Counsel.

Ms Finston obtained her BS from Arizona State University in 1982; her MS from the University of Utah in 1984; and her JD from the University of New Mexico in 1986.
