Biography: Insolvency & Restructuring

Josiah Daniel is a partner at Vinson & Elkins. His practice includes representation of lenders, debtors, creditors' committees, trustees and unsecured creditors in cases under Chapter 11 and all other aspects of bankruptcy and insolvency, including Chapter 11 plan negotiation and confirmation; fraudulent transfer and preference actions; other adversary and bankruptcy-related litigation; resolution of claims of all types including mass tort claims; section 363 asset purchases and sales; post-petition financing and cash collateral arrangements; real estate leases, equipment leases, and executory contracts; and bankruptcy settlements. His practice also encompasses pre-bankruptcy planning, loan and lease workouts, and out-of-court restructurings.

Mr Daniel's extensive experience has earned him recognition in several publications including The Best Lawyers in America as a leader in bankruptcy and creditor-debtor rights law in 2005-2008; and Chambers USA as one of its leaders in bankruptcy and restructuring law in 2006-2008. Additionally, Mr Daniel was named in Texas Monthly as a "Texas Super Lawyer" in bankruptcy, and creditor and debtor rights law in 2004-2007.

Mr Daniel obtained his BA from the University of the South, Sewanee, in 1973; his JD from the University of Texas School of Law, in 1978; and his MA from the University of Texas, in 1986. He is admitted to practise in the United States Supreme Court; US Courts of Appeal for the Fourth, Fifth, Seventh, and Tenth circuits; and the US District Courts for the Northern, Southern, Eastern, and Western Districts of Texas.
