Biography: Commercial Litigation

Balz Gross is a partner and deputy head of Homburger's litigation and arbitration practice team, which has more than 20 members specialising in international dispute resolution services. Balz Gross is also a member of Homburger's white collar/investigations group and the employment law group. Balz Gross graduated (summa cum laude) from the University of Zurich in 1989 (lic iur) and received his doctorate in 1996. He graduated from Harvard Law School in 1995. Before joining Homburger in 1995, he was a scientific assistant for private international law and a law clerk with a district court.

Balz Gross's practise focuses on international arbitration proceedings (including ad hoc, ICC, LCIA and Swiss Rules) and complex domestic and international litigation. He has acted as party counsel in more than 50 international arbitrations, in particular in proceedings relating to mergers and acquisitions, long-term supply contracts, distribution contracts and joint ventures. Balz Gross has also acted as co-arbitrator and sole arbitrator in several international arbitrations. Balz Gross acts as counsel in large, mostly international proceedings before the state courts in all Swiss cantons, in particular the Commercial Courts, and represents foreign and Swiss clients in proceedings involving criminal law issues. Balz Gross has published articles on legal proceedings, fraud and money laundering, recovery of assets and liability in tort. His thesis focused on liability of the state. He is a co-author of the commentary on Swiss cartel law (section on procedure), of the commentary on the Swiss federal act on jurisdiction and enforcement (section on contracts), and the commentary on articles 68 to 96 of the Swiss Code of Obligations (relating to performance).
