Biography: Commercial Litigation

David Hertz (BA, LLB) is the head of litigation and dispute resolution at Werksmans, a major South African law firm. He has been with the firm since 1989 and a director since 1993. Mr Hertz was appointed to his current position in 2005.

Mr Hertz is experienced in all fields of commercial litigation and has been involved in many high-profile and precedent-setting matters during the past 15 years. He regularly represents corporations, directors, officers and employees in complex litigation, particularly in matters involving simultaneous civil, criminal and administrative proceedings.

Mr Hertz has represented corporations and their officers in cases involving unlawful competition, misappropriation of assets and corporate opportunities, food adulteration and conflicts of interest. His clients include Xstrata, Investec, Mittal, Uranium One and Nando's.

Mr Hertz lectures on civil proceedings and is a past member of the International Bar Association.
