Biography: Product Liability
Francesca Rolla is the head of Lovells' dispute resolution practice in Italy. She has almost 20 years of experience as a litigator, specialising in product liability and general commercial litigation. In her product liability practice, Francesca has extensive and diverse experience in the defence of claims against companies in the pharmaceutical, automotive, aerospace, chemical and tobacco fields. She is currently managing a significant number of cases brought against one of the leading tobacco manufacturers for damages related to smoking, as well as claims against pharmaceutical companies and major manufacturing multinationals.
Besides handling proceedings in courts and tribunals at all levels, Francesca advises clients on strategies to reduce their potential exposure to litigation and in assessing pre-litigation remedies, as well as on non-contentious issues such as product safety and product recalls.
Francesca's most recent work includes defending a leading pharmaceutical company against multiparty claims brought in Italy by users of its products, including working with lawyers in the US and Europe in a coordinated effort, and defending a leading tobacco company against a large number of claims filed in various Italian courts for damages to compensate for injuries allegedly caused by smoking. She is also assisting a global manufacturer of semiconductors in a large multiparty product liability dispute for alleged defects in semiconductors installed in computers supplied to the Italian Military. On the product safety side, Francesca is currently assisting a number of clients in liaising with the Italian authorities to make appropriate notification under European General Product Safety Legislation implemented in Italy.
Francesca Rolla also assists clients in supporting motions for forum non conveniens and, more generally, advising on Italian legislation in respect of foreign proceedings involving issues of Italian substantive and procedural law. In addition, Francesca and her team work closely with the product liability and dispute resolution teams of Lovells' international offices in handling complex cross-border litigation.

She is currently managing a significant number of cases brought against one of the leading tobacco manufacturers for damages related to smoking.
Francesca regularly advises clients from the pharmaceutical industry in complex national and multi-jurisdiction disputes, on strategies to reduce their potential exposure to litigation and in assessing pre-litigation remedies, and on non-contentious issues such as product safety and product recalls. She also assists clients in supporting motions for forum non conveniens and, more in general, in providing advice in foreign proceedings involving issues of Italian substantive and procedural law.
Besides defending manufacturers of pharmaceuticals and medical devices in product liability litigation, she is presently defending a leading pharmaceutical multinational against several claims brought following withdrawal of a drug from the market, including claims filed by plaintiffs' lawyers connected with the largest Italian consumers' association.
Francesca is the Italian representative of Lovells' Class Action Unit and is now advising clients on the possible impact on their business of the recently enacted Italian law on collective actions.
Francesca is author of several publications and frequently speaks at seminars on product liability issues.
