Biography: Patents

Dr Pagenberg was educated at Harvard Law School (LLM, 1973), University of Munich (Dr jur, 1974) and spent six years as a research fellow at the Max Planck Institute for international patent law from 1973 to 1979. Admitted to the Munich Bar in 1973, Dr Pagenberg is co-founder and partner of Bardehle Pagenberg since 1979. The firm combines attorneys and patent attorneys specialising exclusively in intellectual and industrial property law, with offices in Munich, Düsseldorf, Paris and Alicante. Dr Pagenberg's personal specialisation is litigation and licensing.

He is co-editor of the International Review of Industrial Property and Copyright Law (IIC) since 1973 and the author of four books and over 80 articles in patent and trademark law. Book titles include: Interpretation of Patents in Europe-Application of Article 69 EPC (co-editor Prof Cornish); License Agreements, 5th edition, Cologne 2002; Manual on the European Community Trademark, 1996; and Case Book on Art 56 and 57 of the European Patent Convention.

Dr Pagenberg has been appointed special adviser of the German Justice Department for the preparation of the European Patent Litigation Protocol and the Community Patent system and as an expert of the European Working Party for Litigation (EPLA). He serves as vice president of the European Patent Lawyers Association and chairman of the AIPPI's committee on litigation, as well as the INTA OHIM special committee. He is a member of the trademark committees of LES, and of other organisations like AIPLA, ALAI, IBA, German-American Chamber of Commerce, and ATRIP.

Dr Jochen Pagenberg is a co-founder of the IP law firm Bardehle Pagenberg Dost Altenburg Geissler, Munich. He holds the degrees of LLM (Harvard) and Dr jur (University of Munich) and is admitted to the Munich Bar and to the Paris Bar.

Dr Pagenberg covers all fields of IP litigation and consultation. In his representation of cases before the German courts, the EPO and OHIM, there is no technical or legal field in which he has not yet successfully represented his clients, from patents to trademarks and copyrights, European competition law, arbitration and mediation.

Important trademark cases concerned unlawful importation of consumer products, worldwide delimitation agreements between suppliers of electronic components, opposition proceedings before the boards of appeals of the Community Trademark Office and the European Court of First and Second Instance, trademark screening and consulting on promotion campaigns of new product launches in the fields of food, body care and household goods. Dr Pagenberg has successfully litigated cases of counterfeiting and piracy for owners of famous trademarks.

He has published six books and more than 80 articles on industrial property law, is the co-editor of the International Review of Industrial Property and Copyright Law (IIC), lectures at the Universities of Strasbourg (CEIPI) and Alicante, Pierce Law Center (Concord NH) and the Munich Industrial Property Law Center of the Max Planck Institute.

Dr Pagenberg is chairman of the INTA subcommittee for community trademarks, chairman of the AIPPI special committee on litigation concerning European patents, and holds a number of other positions in IP associations a well as on the IP advisory board for the German Justice Department for patent litigation.
