Mr McDougall's practice encompasses most aspects of corporate and commercial dispute resolution. His expertise in trial and appellate advocacy is reflected in leading cases in many different areas of Canadian law. One of the leading civil litigation lawyers in Canada, he has appeared in a wide variety of complex cases in the courts and arbitrations. Over the past 15 years he has coupled his work as counsel with an active practice as an international commercial arbitrator. He was appointed Queen's Counsel in 1980, and was elected to the American College of Trial Lawyers in 1991.
Mr McDougall has recently been active in the defence of class actions brought against multi-national clients, particularly those based on allegations of breaches of securities laws and audit negligence. He has also provided advice on reinsurance matters to international clients and, at present, he is involved in a number of cross-border proceedings.
In 2005, Mr McDougall was elected as chairman of the Canadian National Arbitration Committee of the International Chamber of Commerce and he is also a Canadian representative to the ICC Commission on Arbitration in Paris. He is a member of a number of panels of international arbitrators including the ICDR, LCIA, CPR and several Canadian international panels. He is an honourary member of the Commercial Bar Association of England and Wales.
Mr McDougall is a frequent speaker and author on legal issues, both domestic and international.
