Biography: Competition

M Elaine Johnston is a partner in the New York office of White & Case LLP and specialises in antitrust law. She has extensive experience advising on the antitrust aspects of mergers, acquisitions and joint ventures and is experienced in coordinating US, European and other foreign antitrust clearances on complex cross-border deals. Ms Johnston has handled deals for ABB, Agfa-Gevaert, Deutsche Bank, First American, Raytheon, Saudi Aramco, Smiths, Visa International and Volvo, among other companies. She has an active antitrust litigation practice and is representing Experian and Saudi Aramco in pending cases. Ms Johnston also regularly advises companies on worldwide distribution and licensing arrangements (including patent pools); counsels trade associations on the permissible scope of their activities under US antitrust rules; and advises companies facing investigations by US government antitrust authorities and parallel proceedings in other jurisdictions.

Ms Johnston is a member of the American Bar Association antitrust section and serves on the editorial board of Competition Laws Outside the United States, an ABA publication. She serves on the executive committee of the antitrust law section of the New York State Bar Association. She has been recognised as a leading antitrust practitioner by many publications, including Chambers USA, PLC-Which Lawyer? and Euromoney, and is a frequent speaker on antitrust issues.

She earned her BA (Hons) in law from Clare College, Cambridge in 1980, and her LLM from the University of Michigan Law School in 1987 where she was a Fulbright scholar. She is admitted to the New York State bar and the US district courts for the southern and eastern districts of New York.
