Biography: Competition

Mr Gyselen's competition law practice primarily encompasses advice and representation of clients in the fields of EU merger control, antitrust law and state aids control. In the past years, his EU merger work included assisting the Belgian port handling company Sea-Invest in securing phase II unconditional clearance of its acquisition of a controlling stake in EMO/EKOM (2006) and assisting Intel in obtaining phase I conditional clearance of its acquisition of McAfee (2011). On the antitrust front, given his previous government experience, Mr Gyselen focuses on areas where antitrust and regulatory issues are intertwined, such as financial services (payment systems) and pharmaceuticals, as well as on cartels. He is currently involved in a number of international cartel cases that are either pending before the EU agency or being litigated in the Luxembourg courts. Mr Gyselen has also assisted the Belgian government in obtaining clearance of state aid cases in the pharmaceutical sector (2008 and 2009). He also represents clients in antitrust cases that are pending before the Belgian Competition Authority.

Mr Gyselen joined Arnold & Porter in 2004 after 20 years of public service at various EU institutions. He spent most of his time at the European Commission (EC), where he was a member of the Legal Service in the early years of his career and later held several senior positions in the Directorate General for Competition (DG COMP). His career at the EC was interrupted by a three-year secondment to the European Court of Justice where he clerked for the then Belgian judge.
