Biography: Construction

Arch Fletcher is a partner at Clayton Utz, where he is a senior practitioner within the construction and major projects group. His specialist construction and major projects experience spans more than 26 years. During this time, Arch has worked on numerous high profile and complex energy, road and transport infrastructure projects throughout Australia and the Asia Pacific region.

His experience and dedication to meeting tight timeframes have made a significant contribution to his clients and to the overall success of projects including the Queensland A$1.88 billion Gateway Bridge Duplication and Gateway Upgrade Project, the Queensland A$543 million Tugun Bypass Project and the Queensland A$340 million Brisbane Airport International Terminal Expansion.

Other significant projects in which Arch has been involved include Australia Pacific LNG Project, Queensland; Brisbane City Hall Restoration Project, Queensland; HRL's IDGCC Power Project, Victoria; Kogan Creek Power Station, Queensland; Condamine Power Station, Queensland; Department of Transport and Main Roads State-wide Road Damage Restoration Project, Queensland and Oyu Tolgoi Power Plant Project, China and Mongolia.

Arch assists clients with the preparation, negotiation and review of a wide range of construction, engineering, procurement, maintenance, operation and consultancy agreements. He has prepared and negotiated contracts and tender documents for a wide range of projects embracing many different delivery methods such as design and construct (including lump sum turnkey and EPC); document and construct; design, construct and maintain (DCM); managing contractor and early contractor involvement (ECI); engineer, procure and construction management (EPCM); traditional construct only (including lump sum, remeasurement and schedule of rates); guaranteed maximum price (GMP); project alliance and public private partnership (PPP). These projects have involved acting for owners, consortia, government departments, agencies and corporations, contractors, consultants, superintendents, subcontractors, suppliers and financiers.

Arch is a member of the Institute of Arbitrators and Mediators and is a sought after presenter within the construction industry, presenting at industry conferences on such issues as Project Delivery Through Alliances and Contract Risk Allocation.

Arch is recognised internationally in various publications as a specialist in the construction law area.
