Biography: Competition

Brian Facey has represented clients in hundreds of competition law matters, including merger transactions, criminal cartel cases, and distribution and advertising matters. He also acts in relation to foreign investment issues under the Investment Canada Act.

Brian is past chair of the International Competition and Trade Law Committee of the Canadian Bar Association. He is active in the American Bar Association antitrust section and the International Bar Association. He is co-founder and past co-chair of the Foreign Investment Review Committee (FIRC). Brian is an adjunct professor of competition law and teaches law at the graduate level. Brian is also a private sector adviser to the International Competition Network. He is co-author of the treatise entitled Competition/Antitrust Law: Canada and the United States (3rd ed), LexisNexis Butterworths (2006).

Brian has spoken to audiences in Canada and abroad, and has written articles for the Antitrust Law Journal, the Antitrust Bulletin, Antitrust Magazine, World Competition, Fordham Corporate Law Institute, and the International Antitrust Bulletin.

Brian was admitted to the Ontario Bar in 1993. He holds an LLM (concentration in antitrust economics and law) from Georgetown University, an LLB from the University of British Columbia and an honours BA (economics) from the University of Toronto.

Brian is recognised as a leading competition law practitioner in Legal Media Group's Guide to the World's Leading Antitrust/Competition Lawyers for Business, The Canadian Legal Lexpert Directory, Chambers Global: The World's Leading Lawyers, and PLC Which Lawyer? Yearbook. He is considered one of Canada's '25 Litigators to Watch' in The 2006 Lexpert/American Lawyer Guide to the Leading 500 Lawyers in Canada, and in the inaugural edition of The Best Lawyers in Canada, published in June 2006, he was voted one of the leading lawyers in Canada in a peer-review survey. He was included in Lexpert magazine as among Canada's top 40 lawyers across all areas of law, 40 years old and younger in 2004.
