Dr Bernheim regularly consults with attorneys on the economic aspects of antitrust litigation. He provides expert testimony in high profile litigation, mergers, and regulatory matters on such topics as market definition, competitive impact, countervailing efficiencies, monopolisation, antitrust liability, and damages. He has authored numerous expert reports and assessed liability or damages for industries including microprocessors, healthcare and pharmaceuticals, vitamins, financial markets, telecommunications, railroads, airlines and aerospace, and manufactured products.
In AMD v Intel, Dr Bernheim served as AMD's testifying expert and submitted expert reports evaluating circumstances under which exclusionary conditions are anti-competitive. He testified at trial on causation and damages in Adelphia Communications Corporation v Motorola. Prior to these cases, Dr Bernheim testified in Amgen v F Hoffman-La Roche on the implications of Medicare reimbursement policies on competition among drug manufacturers and in Enron Creditors Recovery Corp v Citigroup on the impact of alleged accounting fraud and damages attributable to defendants.
Dr Bernheim is the author of more than 125 publications, including 60 peer-reviewed journal articles, four books, and many other professional and academic publications. He holds multiple distinctions, including John Simon Guggenheim Memorial Foundation Fellowship, Center for Advanced Study in the Behavioral Sciences Fellow, American Academy of Arts and Sciences Fellow, and Econometric Society Fellow.
