Biography: Competition

Yves Bériault is one of the leaders of McCarthy Tétrault's national competition law group. He obtained his law degree from the University of Ottawa where he graduated summa cum laude. He also holds degrees in Philosophy, Arts and Economics from the universities of Ottawa and St Paul. After obtaining his law degree, he clerked with the Honourable Gérald Fauteux of the Supreme Court of Canada.

Mr Bériault specialises in the area of competition law. He advises many Canadian and international clients on all aspects of Canadian competition law. He has been involved in many landmark cases involving competition legislation before all courts and the Competition Tribunal.

Mr Bériault has been involved in significant national and international mergers, including: Abitibi-Consolidated's merger with Bowater Incorporated; Molson's merger with Coors; Sanofi-Synthélabo's merger with Aventis; Pechiney's merger with Alcan; CP Ships' merger with TUI.

In addition, Mr Bériault has represented corporations and individuals with respect to several national and international cartel investigations.

For many years, Mr Bériault lectured on Competition Law at the faculty of law of the University of Montreal. He is a former chair of the competition law section of the Canadian Bar Association. He is a frequent guest speaker at many national and international conferences on competition law and authored numerous articles and papers relating to competition law including, more recently: "Immunity in an International Context" at the EU Cartel Law Enforcement: Practice and Policy conference in Brussels, 2006; "Some Aspects of Canadian Law Relating to International Cartels" at the American Bar Association Cartel Conference, in London, 2006; "Le contrat de distribution et le droit de la concurrence", Insight Canada, Montreal, 2005; "Private Access and Section 75 of the Competition Act", at the Competition Litigation Invitational Forum, Northwind Professional Institute, in Toronto, 2005; "Interface Between Competition Law and Regulation", at the Competition Law Invitational Forum, Northwind Professional Institute, Langdon Hall, in Cambridge (Ontario) 2004; "Horizontal Agreements: State of the Reform Process" with Madeleine Renaud, at the Competition Law Roundtable, Faculty of Law, University of Toronto, 2004; "L'application de la Loi sur la Concurrence en Matière de Franchisage", at the Conférence sur le franchisage, Canadian Institute, in Montreal, 2004.

Mr Bériault has also co-authored a book on Canadian competition law (Le Droit de la Concurrence au Canada, Carswell, Montreal, 1999 with Madeleine Renaud and Yves Comtois of McCarthy Tétrault's Montreal office).

Mr Bériault enjoys a solid national and international reputation. He appears as one of Canada's leading competition lawyers in numerous legal publications.

Mr Bériault practises in both French and English languages.
