Biography: Regulatory Communications

Bernard Amory has practised law in Brussels since 1984. While working as an official in the Directorate General IV (competition) of the European Commission, he was in charge of the application of the competition rules in the telecommunications sector and played a key role in the liberalisation of the European telecommunications market. He has extensive experience as a commission official and as a private practitioner in dealing with joint ventures, strategic alliances, and mergers and acquisitions, as well as abuses of dominant position, cartel investigations and state aid matters before the Commission and the European courts. Among the leading telecommunications merger cases in which he represented the notifying party are BT/MCI (1) and (2), and BT/AT&T. He also acts for intervening parties and complainants in merger cases, such as for Apple in Sony/BMG, Tele Denmark in Telia/Telenor and ATT in MCI/WorldCom/Sprint. His recent ongoing representations relating to article 81 (restrictive practices) include the O2/T-Mobile infrastructure sharing and national roaming case on behalf of O2, and the Apple iTunes investigation. He also has significant experience in article 82 (abuses), including the roaming case (on behalf of O2) and Microsoft (on behalf of a third party).

Bernard also represents fixed and mobile operators in a wide variety of regulatory matters and has assisted governments across the world in relation to telecommunications legislation. He has represented the GSM Association before the European Commission, other EC institutions and national authorities in relation to the proposed regulation of roaming charges.

In view of the extensive competition work he did for telecommunications companies, from 2005 to 2007, Bernard was named 'Lawyer of the Year' for regulatory communications by Who's Who Legal. He also has been selected as one of the world's top 20 lawyers by Commercial Lawyer 2000 and is described by Chambers Global's The World's Leading Lawyers as one of 'Europe's finest telecoms lawyers'. Bernard has served as a member of the council of the business law section of the International Bar Association.

His recent ongoing representations relating to article 81 (restrictive practices) include the bananas case for Dole and the Apple iTunes investigation. He also has significant experience in article 82 (abuses), including the roaming case (on behalf of O2) and Microsoft (on behalf of a third party). His experience on state aid and state measures include work for Bouygues.

Bernard is ranked by Chambers in the top 20 competition lawyers in Brussels. In view of the extensive competition work he did for telecommunications companies, in 2005, 2006, and 2007, Bernard was named "Lawyer of the Year" for regulatory communications by Who's Who Legal.
