Mexico: Commercial Litigation

This year there are 17 lawyers in this chapter, a slight fall in listings from last year. The financial crisis saw a shift away from traditional litigation work as lawyers diversified into arbitration and insolvency. They reported that clients look to quicker forms of conflict resolution, and need bankruptcy expertise to facilitate asset and corporate reduction.

Müggenburg Gorches Peñalosa y Sepúlveda SC enjoys three listings in this chapter. A prolific author in business contracts law, Carlos Müggenburg is “one of the few leading, recognised litigators in Mexico” for his work in M&A and IP dispute resolution. Esteban Gorches is the co-head of the administrative and constitutional litigation, commercial litigation and IP and entertainment law groups. He has specific experience in disputes relating to public works agreements and industrial property rights. He is considered “very very good” by his peers, as is Alfonso Sepúlveda García, former general counsel of Pegaso Comunicaciones y Sistemas in association with the US entity Sprint PCS. He has a general litigation practice, with broad experience acting in professional liability litigations.

At Martínez Algaba de Haro Curiel y Galván-Duque, Jorge De Haro Gonzalez concentrates on mercantile, insolvency and bankruptcy litigation and resolving administrative disputes. He has a lot of experience representing major clients in insolvency proceedings. Former legal counsel for the federal government, the “terrific” Roberto Martínez Guerrero is recommended by peers and clients for his insolvency and restructuring related conflict resolution.

Everardo Hegewisch Arrillaga of Hegewisch Abogados SC has over 50 years of experience working within the civil, trade and financial practice area, representing domestic and foreign clients on negotiations, settlements and drafting, among other areas. Fernando Hegewisch Diaz Infante specialises in civil, trade and finance law. He is a “respected” practitioner in this field.

Aguinaco Abogados is represented in this chapter by Fabian Aguinaco Bravo who is “one of the best litigators” and an “active tax specialist” according to our contributors.

Quijano Cortina López y de la Torre is “possibly one of the best firms for international litigation in Mexico”. Javier Quijano Baz is an expert with over 30 years of experience acting for major foreign corporations.

Barrera Siqueiros y Torres Landa SC boasts the “excellent” Luis Omar Guerrero Rodríguez. He is the head of an active litigation department and is known for his work in civil, commercial and administrative disputes, with a focus on EC and immigration law.

Ricardo Hernández Garfias from Basham Ringe y Correa SC heads the 11-strong litigation department, which is one of the law firm’s core strengths. He has over 20 years of experience in commercial and civil dispute resolution, regularly acting in federal and state conflicts involving contracts, insolvencies, bankruptcies and arbitrations.

Former president of the Mexican Bar Association, Luis Enrique Graham at Chadbourne & Parke LLP is best known for complex, commercial litigations and arbitrations and features in both those chapters. He has extensive representative experience, including coordinating a FCPA review in Mexico for a leading pharmaceutical company, acting as lead counsel in an insurance dispute involving a US company and advocating for a US corporation in a real estate dispute over industrial facilitates.

Founding partner and senior litigator Enrique González Calvillo of González Calvillo SC is a leading lawyer in a range of areas. He features in the arbitration and litigation chapters for his “strong dispute practice” and has taken part in some major claims, including Grupo Modelo’s claim for damages against its parent company Anheuser-Busch. At González de Castilla Abogados SC, Emilio González de Castilla Jr is a commercial and contracts lawyer who works in the arbitration and litigation fields and features in both chapters. He received praise from peers.

Carlos Loperena at Loperena Lerch y Martín del Campo served as adviser during NAFTA dispute resolution negotiations and concentrates on dispute resolution in corporate and trade contracts.

At Santamarina y Steta SC, Fernando del Castillo is ‘pre-eminent’ in litigation, insolvency and arbitration. A major part of his practice involves advising on contract breaches, shareholder disputes, restructurings and collection work.

Claus von Wobeser of Von Wobeser y Sierra SC, received international plaudits for his representation of major companies such as Anheuser-Busch and pro bono services for groups such as the Nature Conservancy. He is an established litigator and a “brilliant” arbitrator. He represents the firm in both those chapters.
