Brazil: Patents

Brazil’s economic growth has had a significant impact on the activity of the patents industry. The government is making plans to halve the examination period of patent applications by 2015, in order to bring Brazil more into line with other countries. These plans highlight the importance of the patent industry in Brazil, which itself requires highly specialised counsel. Thirteen lawyers have been selected as forerunners in this field.

The “experienced and long established” patents practice at Dannemann Siemsen Bigler & Ipanema Moreira has earned the accolade of being the most represented firm in this chapter, with an “impressive” total of four lawyers listed. Peter Dirk Siemsen is considered a “highly experienced” practitioner in this field, consistently nominated in our research. David Merrylees is a “great lawyer” described as “top-notch” by one interviewee. Gustavo de Freitas Morais is a “skilful litigator” in the field, and alongside him, head of litigation Joaquim Eugenio Goulart is “top-tier”.

Gusmão & Labrunie performs well with two lawyers featured. José Roberto d’Affonseca Gusmão is a “high profile” lawyer and a former president of the Brazilian Patent and Trademark Office. Jacques Labrunie, a counsellor of the board of directors of the Brazilian Association of Industrial Property Agents was identified in our research as a “top-tier” lawyer.

IP boutique Momsen Leonardos & Cia has two “talented” lawyers listed. Luiz Leonardos is “renowned” for his litigation work, while Otto B Licks concentrates his practice on pharmaceuticals and information technology. An “experienced” litigator, Licks has worked for the chairman of the intellectual property working group of the Free Trade Area for the Americas.

Founding partner of Daniel Advogados Denis A Daniel is considered an “expert” in the field and is president of the legal committee of the British Chamber in Rio. Marcello do Nascimento, a partner at David do Nascimento Advogados Associados is a patent “whizz” as well as being a consultant for a wide variety of IP issues. Gabriel Di Blasi from the firm Di Blasi Parente Vaz e Dias & Associados is nominated for “top class” patents work.

The “highly respected” Karin Klempp Franco, the founder of Karin Klempp Sociedade de Advogados, concentrates her expertise in the food, cosmetics and pharmaceutical industries. Maristela Basso of Maristela Basso Advogados is “very active” in the sector, advising domestic and foreign companies primarily in pharmaceuticals and cosmetics.
