Brazil: Business Crime Defence

Brazil’s business crime legal marketplace has not been untouched by the global recession: the financial crisis spawned a general uptick in white collar criminal defence work as regulatory scrutiny increased worldwide and financial crimes, such as money laundering, reporting irregularities and insider trading, came to light. Brazilian firms recognise the need for stronger and more expert defence advice to cater for their international clients’ needs in today’s economic climate.

José Carlos Dias of Dias & Carvalho Filho Advogados is a “senior statesman”. The former president of the Justice Commission, secretary of justice and minister of justice for São Paulo, Dias is widely “respected” for his public service record.

Another former secretary of justice for São Paulo, Miguel Reale Júnior at Reale e Moreira Porto Advogados Associados is a leading criminal defence lawyer who counsels and acts for clients in cartel, embezzlement, tax evasion and insider trading prosecutions, among many areas.

René Ariel Dotti of his own firm has many years experience providing advice and representation in this field. He is a prolific author on business crime and reform.

From his base in Rio de Janeiro, Otto Eduardo Fonseca De Albuquerque Lobo of Motta Fernandes Rocha Advogados advises and assists in asset tracing during investigations. His client list includes some of Brazil’s most celebrated companies.

Antenor Madruga of Barbosa Müssnich & Aragão has practiced in this area for many years and heads the firm’s anti-fraud and corporate ethics practice. He provides specialist advice on the Foreign Corrupt Practices Act, and on international asset tracing and recovery. He is a “dedicated” fraud and white collar crime lawyer.

Jorge Nemr at Leite Tosto e Barros Advogados Associados has an “impressive”  practice. He is well known for his multi-jurisdictional work, which combines his litigation and business crime defence expertise. He advises on compliance for a range of companies and individuals and is part of a team known for its “efficient” approach to meeting clients’ needs.

Based at the head office of Machado Meyer Sendacz e Opice Advogados in São Paulo is business and dispute resolution expert Domingos Fernando Refinetti.

The “very talented” Antônio Sérgio Altieri de Moraes Pitombo from Moraes Pitombo Advogados is a “good name” in business crime and regularly acts in high profile cases on behalf of  top corporations and individuals in the country’s Supreme Court.
